THIS INDENTURE made the twentyth day of June in the
second yeare of the raigne of our soveraigne Lord Charles by the
grace of god king of England Scotland ffrance & Ireland defendor
of the fayth &c Betwene Sir John Brune of Athelhampston in
the countye of Dorset knight & Dame Bridget his wyfe of thone
parte And Robert Lock of Rownor Grange in the county of South't
yeoman of thother parte WYTNESSETH yt the sayd Sir John Brewne
and Dame Bridget aswell for & in considerac'on of the yealding,
cancelling & Surrendring up of div'rs leases heretofore made
parcell of the farmes of Rownor & Grange in the county of
South~t viz:
one lease heretofore made unto one Robert Drewe gent
parte therof by the rent of xxviij~li per annu': And one lease
heretofore made to Richard Jenby of another parte therof by the
rent of [...]~li Also one other lease heretofore made to one Richard
Hollis merchant of another parte therof by the rent of ffyfty
pounds per annu' Also one other lease heretofore made unto one
Lambert Peachy of another parte therof by the rent of v~li x~s
As for div'rs other good causes & considerac'ons them thereunto
especyally moving HAVE demysed granted & to farme letten &
by theis Pre'nts doe demyse grante & to farme let unto the
sayd Robert Lock All those theire Twoe Capitall messuages &
ffarmes called & knowne by the name or names of Rownor &
the Grange in the County of South~t: Together w~th all barnes,
stables, stales, edyfices & buildings, w~th the gates, orchards,
& gardens thereunto belonging, and all and singuler lands,
ten'ts, meadowes, closes, earable groundes, Coppices, pastures,
Comons & Comon of pasture, wayes, pathes, waters, watercourses,
easem'ts, and comodyties whatsoever to the farmes or eyther of
them of, & belonging to the sayd Capitall messuages or ffarme
houses belonging, or therw~th nowe or of late used, occupyed or
enioyed as parte or parcell of the same EXCEPT and alwayes reserved
oute of this pre'nt demyse or grante unto the sayd Sir John Brune
& Dame Bridget his wyfe theire heires and Assigns All &
alman'r of Royalties of ffree warren & of hunting, hawking,
fyshing, fowling, wreakes of the Sea, strayes, felons goodes,
& all other Royaltyes whatsoever: Alsoe alman'r of trees,
woods, underwoods, coppice woods nowe standing, growing &
being or which hereafter shall stand growe or bee in & uppon
the Coppices called fatting leaze Coppice, Parsons Coppice, and
woodclose Coppice parcell of the premisses, or in or uppon any
other parte or parcell therof w~th free liberty ingresse, egresse
& regresse to & for the sayd Sir John Brune & Dame
Bridget his wyfe theire heires & assignes at all tymes hereafter
& from tyme to tyme at his, hir & theire will & pleasure
during the terme hereafter menc'oned to fell, cutdowne, have,
take and carry away the sayd trees woods & underwoods w~th
any carriage or carryages whatsoever Leaving fynding & allowing
unto the sayd Robert Lock his executors & assignes at all
tymes needfull during the sayd terme such & soe much housboote,
hedgboote and other bootes & allowances as are hereafter by
theis pre'nts granted & menc'oned to be allowed unto him uppon
some parte of the afore letten premisses And also except &
unto the sayd Sir John Brune & Dame Bridget reserved One parcell
of peate ground in the utter heath conteynyng by estymac'on Ten
acres (be yt more or lesse) w~th liberty of ingresse, egresse
& regresse in, over & throughe all & every parte &
parcell of the sayd twoe farmes called Rownor & the Grange
to & from the sayd parcell of peate grounde to dig, drawe,
cutt, drye, & carry away all the sayd peate there to be made
at his, hir or theire will & pleasure dureing the sayd terme
not doeing or suffering to be done any wilfull spoyle, hurt or
destrucc'on to the Corne, grayne or mowet w~ch uppon the sayd
premisses or any parcell thereof shalbe growing or being TO have
& to hould the sayd twoe Capitall messuages or farmes w'thall
& singular theire appurtenances (except before excepted) unto
the sayd Robert Lock his executors & assignes from the feast
day of St. Michaell Tharchangell last past for & duringe all
the whole terme & tyme of one and twentye yeares from thence
next following & fully to be compleate & ended YEALDING
and paying therefore yearly during the sayd terme unto the sayde
Sir John Brune & dame Bridget theire heires or assignes The
yearly rent of Eightscore ffower pounds & ten shillings lawfull
mony of England in man~r & forme following That is to say
lij~li v~s uppon the feast day of St John ye babtyst: and thirtye
pounds uppon the feast day of St Michaell Tharchangell and lij~li
v~s uppon the feast day of the natyvity of our savy~r Christ and
thirtye pounds uppon the feast day of Thannu'tiac'on of the blessed
virgin St Mary And also doing suite of Court for all & evry
the Court & Courts of the sayd Sir John & Dame Bridget
theire heirs & assignes to bee houlden for the Mano~r of Rowno~r
in the County of South~t And to be iustyfyed & ordered by
the same Court & Courts for all matters determynable therin
and for all such reasonable fynes & annoianc's as shall touche
& concerne the premisses in like causes as other the Tenants
of the said mano~r there bee, or have used or accustomed to bee
AND the sayd Robert Lock doth by theis pre'nts for himself his
executors & administrators covenant promise & grant to
& w~th the sayd Sir John Brune & Dame Bridget his wyfe
theire heires & assignes That hee the sayd Robert his executors
& assignes shall & will twice in the yeare viz: aboute
the feast of St Michiell Tharchangell & the feast of Thannu'tiac'on
of the blessed virgin St Mary make & provyde good & suffycient
provysion for six men & six horses, meate & drinck of
the best for the men & at ordenary houres in the day That
is to say breakfast at eight of the clock in the mornyng, dynner
at the houre of Eleaven and supp~r at six of the clock in thafternoone
& theire lodging in the best & fayrest roomes of the house
And meate, water, lytter, provender & dressing for the horses
and other good provysion for them according to ye tymes of the
yeare for the space of three nights and twoe whole dayes yearly
during the sayd terme AND also the sayd Rob't Lock his executors
& assignes shall & will at other twoe tymes in the yeare
viz: about mydsomer & Christmas make & provide the like
provysion & entertaynem't in all respects for three men &
three horses for twoe nights & one day that shall come &
be ymployed for the sayd Sir John and Dame Bridget or either of
them, or the heires or assignes of either of them AND alsoe the
sayd Robert his executors & assignes shall & will uphold,
susteine & maynteine all & singular the houses, edifics
& buildings, hedges, ditches, & fences & all other
needfull & necessary reparacons when & as often as need
shall requier at his & theire owne per pro costs & charges
Saving that towards the mayntenance therof y~e sayd Rob't his
exeuctors & assignes shall & may lawfully have & take
suffycient hedgeboote, fyreboote, ploweboote, Cartboote, rayleboote,
gateboote & wattleboote in & uppon the premisses (except
onely in the afore recyted Coppices) And also shall & may
have suffycient store of greate tymber from tyme to tyme for the
repayring of the sayd houses edyfices & buildings in &
uppon the premisses by the deliv'ry & appoyntm't of the lord
or his officers for the tyme being AND yf yt happen the sayd yearly
rent above reserved or any parte or parcell therof to be behind
& unpayd in man~r & forme aforesayd by the space of six
dayes next after any the feasts or dayes of payment aforesayd
That then the sayd Robert Lock his executors & assigns shall
& will forfyt & pay for ev'ry such defalt & none payme~t
the some of ffyftene pounds lawfull mony of England (noie pene)
And that yt shall & may be lawfull to & for the sayd Sir John
Brune & Dame Bridget theire heires & assignes & the
heires & assignes of the sayd Sir John into all & singular
the before demysed premisses w~th thappurtenances to enter &
there to dystraigne And the dystres & distresses there soe
taken & had to leade, dryve & carry away & the same
to deteyne & kepe untill the sayd yearly rent of Clxiiij~li
ten shillings evrye parte & parcell therof & tharreareges
of the same (yf any be) and the sayd some of xv~li (noie pene)
forfayted as aforesayd shalbe fully satysfyed & payde AND
yf the sayd Robert Lock his executors admynistrators or assignes
shall make or cause to be made any wast or spoyle in & uppon
the premisses or any parte thereof to the value of ten shillings
& the same bee founde & the value therof presented by
the Jury and doe not make satysfacc'on w'thin one quarter of a
yeare then next following after such presentm't to the Steward
or offycers of the sayd Sir John & Dame Bridgett theire heires
& assignes for the tyme being: Or yf yt shall happen that
the sayd yearly rent of Cliij~li and x~s to be behind & unpayd
in parte or in all by the space of Twenty dayes next after any
of the feasts or dayes of payem't aforesayd in w~ch the same ought
to be payd the same being first lawfully demanded at or in One
of the sayd Capitall messuages That then & from thenceforth
for all or any the causes afore sayd yt shall & may be lawfull
to & for the sayd Sir John Brune & Dame Bridget theire
heirs or assigns into all & singular the sayd demysed premisses
to reenter & the same to have agayne reposses, deteyne, kepe
& enioye as in his & theire first & former estates:
And the sayd Robert Lock his executors & assignes utterly
to expell & put forth any thing herein conteyned to the contrary
in any wyse notw'thstanding AND the sayd Sir John Brune for him,
his heires executors & admynistrators doth covenant &
grant by theis pre'nts That the sayd Robert Lock his executors
& assignes under the rents, reservac'ons, covenants &
condic'ons before expressed shall quietly and peacably have, hould
& enioye the before demysed premisses w~th theire appurtenances
& every parte therof (except afore excepted) without let,
trouble or lawfull denyall of the sayd Sir John Brune or of the
sayd Dame Bridget theire or eyther of theire heires or assignes
or by any other person or persons whatsoever having claymyng or
lawfully pretending any man~r of estate, terme, tytle or interest
of, in or oute of the premisses by from or [...] him, them or
any of them In wynes whereof the sayd parties to theis pre'nt
Indentures interchangably have set to theire hands and seales.
